GENERAL TERMS AND CONDITIONS OF AAS APARTMENT SERVICE AG

  1. Scope of application
    These General Terms and Conditions (hereinafter referred to as “GTC”) are an integral part of the rental agreements concluded and their provisions are binding. They govern the relationship between the tenant and AAS Apartment Service AG (hereinafter referred to as “AAS”, “we”, “us” or “our”). Deviations from these GTC only apply if they have been explicitly agreed between the tenant and AAS and are recognized in writing.

  2. Conclusion of contract
    2.1 Rental property and use
    a. The apartment is provided furnished and with the features described in the advertisement. The apartments shown on our website correspond to the style of the apartment. Deviations from the pictures are possible. The apartments can be viewed prior to booking.
    b. Tenants may only use the apartment for residential purposes. The tenant may only sublet the property in whole or in part with the written consent of the landlord. Commercial use is not permitted.
    c. The house rules must be observed.

    2.2 Rental commitment apartment
    a. The rental commitment for an apartment is binding as soon as we receive it in writing through a signed rental agreement, oral commitment or e-mail confirmation.
    b. An advance payment of 30 % of the total amount needs to be made within 3 days after signing the agreement. Please note that if the payment deadline is not met, the availability of the apartment can no longer be guaranteed. The apartment may be re-let as long as no deposit has been paid.

  3. Prices and payments
    3.1 Payment terms
    All prices are in Swiss francs (CHF) and include the statutory value-added tax (VAT) at the applicable rate. The rent is owed in advance. The deposit is paid jointly with the first rent. Keys for the apartment are only handed over after the due first rent and the deposit are paid according to the rental agreement. If a tenant stays up to 3 months, the VAT is charged on the rent and the service. If a tenant stays for more than 3 months, VAT will not be charged on the rent. The service is always subject to VAT and is charged to the tenant.

    3.2 Payment methods
    We accept all usual means of payment (Bank transfer, VISA, Mastercard, American Express, Debit card, Cash).

  4. Late rental payment
    A reminder fee of CHF 100.00 is charged for late rent payments.

  5. Provision of keys – Moving in
    a. The keys will only be handed over after payment of the first rent due and the deposit in accordance with the rental agreement.
    b. The keys are handed over personally in our office or are provided in the relevant key safe of the property as far as the first rent and the deposit have been paid.
    c. Check-in is possible from 3:00 p.m.

  6. Obligation to report
    The tenant must report any defects in the apartment and its furnishings immediately (within 3 days at the latest) after moving in. The tenant is liable for any damage that is not reported.

  7. Duty to register
    The tenant shall register with the competent registration office within 8 days.

  8. Cleaning

    a. Weekly cleaning
    The apartments will be cleaned once a week. The bed linen and bathroom towels will be changed once a week. The tenant agrees that employees of AAS Service Apartment AG may enter the apartment without prior notice, while respecting privacy. We ask the tenant to leave the apartment in a tidied state and to remove all dishes from the kitchen (dishes in the dishwasher), so that the cleaning personnel can guarantee perfect and efficient cleaning. 
    b. Final cleaning
    After the tenant has moved out, a final cleaning will be carried out that is due for payment jointly with the first rent. If this exceeds the normal degree and/or if excessive waste or personal items must be removed, we will charge this additionally. Any damage will be noted during the final cleaning and deducted from the deposit.

  9. Access to the apartment
    We strive to inform the affected tenant in due time prior to an imminent apartment access, where possible. However, the tenant agrees that employees of AAS Apartment Service AG may enter the apartment without prior notice, while respecting privacy, in particular for repairs, maintenance work, or technical inspections. In the case of terminated apartments, viewing appointments with potential new tenants may also be carried out without prior notice.
  10. Smoking ban 
    All our apartments are non-smoker apartments, i.e. smoking is not permitted in the apartment. We are asking you to keep this in mind also with regard to the new tenant. All costs accruing due to damage caused by smoking will be passed on to the tenant.

  11. Termination
    a. Termination up to 30 days prior to the start of the tenancy does not cause any costs.
    b. For termination less than 30 days up to 15 days prior to the start of the tenancy, an administrative fee of 10 %of the rent becomes due for payment. The minimum fee amounts to CHF 200.00.
    c. If the rental agreement is terminated less than 15 days prior to the start of the tenancy, the entire contractual rent is owed; however, this amount does not exceed 1 monthly rent. If the customer provides for an adequate new tenant, an administrative fee of 10 % of the monthly rent is due for payment, at least CHF 200.00.
    d. If a tenant has a rental agreement with a limited term and moves out before the agreement ends, the rent is still owed until the end of the agreement, unless the tenant provides for an adequate new tenant.
    e.Tenants who do not pay the rent and/or tenants who are in delay with the payment of the rent may be evicted immediately, and the apartment may be let to a new tenant. 
    f. Any potential contractual privileges granted due to the agreed long term of the agreement may be cancelled with retroactive effect and invoiced to the tenant if the agreement is terminated early.

  12. Delayed arrival / commencement of the rental period
    In the event of a delayed arrival or late commencement of the rental period, the rental fees shall still be payable from the contractually agreed start date.

  13. Renewal of the rental agreement
    a. If notified in due time and depending on availability, a new rental agreement may be concluded. If the tenant wishes to renew the rental agreement, they shall notify this within 30 days prior to the expiry of the rental agreement. If this deadline is not complied with, it cannot be guaranteed that the apartment will still be available after the agreement expires.
    b. Due to the additional administrative expenses, the daily rent agreed according to the rental agreement, which is higher than the monthly rent, will be charged if the term of the tenancy is only renewed on a daily or weekly basis.
    c. For monthly renewals of the rental period of less than six months, the regular monthly rental rate applies without any previously granted discounts.
    d. If the reservation is renewed, the rent must be paid in advance, unasked and until 3 days prior to the start of the reservation at the latest. If the payment is not received by this deadline, the previously agreed reservation period shall automatically end. We reserve the right to adjust the rent if an agreement is renewed.

  14. Modifications to the agreement
    If modifications are made to the agreement subsequently on the tenant’s demand and if they require the new issue of the rental agreement, an administrative fee amounting to CHF 150 is charged.

  15. Moving out – return of keys
    a. Upon termination of the rental agreement, the tenant must vacate the apartment without reminder and return the keys.
    The keys must be returned no later than 10:00 a.m., either to the office or to the designated key safe. The tenant has to contact the office one week prior to the moving out date in order to schedule the return of the keys.
    b. If the keys are not returned in due time, we reserve the right to issue an invoice for late return to the tenant,
    usually in the amount of one daily rate of the rent. If the keys are not returned and the tenant fails to vacate the apartment on time, AAS is entitled to clear the apartment.
    For the safety of the new tenant, a fee of CHF 800 will be charged to the tenant for replacing the keycylinder.

  16. Loss of keys 
    For the safety of the tenant, a fee of CHF 800 will be charged to the tenant for replacing the keycylinder. 

  17. Deposit repayment
    The deposit will be reimbursed within 4 weeks given on the reimbursement form, to the original method of payment. All outstanding items as well as damage caused by the tenant are set off against the deposit.

  18. Parking space rental 
    The rental of parking spaces is not part of this agreement. Any related claims and conditions shall be governed by a separate rental agreement between the parties.

  19. Basement/storage rooms
    Basement and storage rooms may be rented additionally upon request and subject to availability, for an additional fee.

  20. Internet use
    Every apartment has its own free WLAN. The tenant is not permitted to make any modifications to the installations and configuration. In case of non-compliance, the tenant will be held liable for the costs of any potentially required reinstallation or troubleshooting. We do not accept any liability for damage caused by spam, viruses, spy software resulting from the use of the AAS network. We strive for a constantly functioning Internet line, but cannot give any guarantees, and we do not accept any liability in this regard.

  21. Use of excercise equipment
    Every tenant is responsible for their use of the exercise equipment. Please use this equipment correctly and notify any damage immediately. We do not accept any liability for the use of the exercise equipment.

  22. Allergies
    AAS uses industry-standard products for cleaning, laundry, and maintenance. The tenant is responsible for informing us in advance of any allergies or intolerances to cleaning, laundry, or care products, as well as other products used in the apartment. We do not accept any liability for allergic reactions or health issues resulting from contact with these or similar substances.

  23. Pets
    a. Pets are only permitted with the prior consent of AAS. Additional costs may be incurred for keeping pets. The tenant is fully liable for any damage caused by the pet.
    b. Any breach of this provision constitutes a good reason for immediate termination of the rental agreement by AAS. In this case, the tenant owes the entire contractual rent; however, the maximum is 1 monthly rent. If the tenant provides for an adequate new tenant, an administrative fee of 10 % of the monthly rent, which amounts to at least CHF 200, becomes due.

  24. Emergency
    An emergency phone number is available to the tenant. We charge emergencies the tenant is responsible for, such as loss of keys and emergencies that could have been dealt with within the normal business hours, at an hourly rate of CHF 150 plus commuting costs. The security key service company will be charged additionally (cost depending on the time required).

  25. Liability
    a. The tenant undertakes to treat the apartment, inventory, and building with care. Damage that is not attributable to normal wear and tear, as well as missing inventory, will be charged to the tenant and deducted from the deposit (see clause 17). If failure to observe the duty of care requires renovation of the apartment, the tenant shall be liable for the resulting loss of income.
    b. AAS accepts no liability for the loss or damage of valuables kept in the apartment.
    c. The tenant is responsible for obtaining their own theft and liability insurance. We do not accept any liability.

  26. Apartment use
    The apartment is to be used exclusively for residential purposes. Subletting or commercial use is not permitted. In case of illegal or non-contractual use of the apartment, we reserve the right to terminate the tenancy without notice. The tenant is liable to pay the still outstanding rents according to clause 10.

  27. House rules
    The general house rules as displayed on the notice board in the staircase of the relevant properties shall be complied with. 
    Bicycles are not allowed in the apartment, on the balcony or in the staircase. They can be parked in the bicycle stands which belongs to the property.

  28. Applicable law and place of jurisdiction
    Swiss law applies to this agreement. The parties acknowledge the courts of law at the registered office of AAS as place of jurisdiction for disputes arising from this agreement.

  29. Data protection
    Personal data is collected from all guests in connection with their stay at AAS Apartment Service AG. We process personal data in accordance with the Swiss Federal Act on Data Protection (FADP), the Ordinance to the Federal Act on Data Protection (DPO), and, where applicable, the EU General Data Protection Regulation (GDPR).
