GENERAL TERMS AND CONDITIONS OF AAS APARTMENT SERVICE AG
1. Scope of Application
These General Terms and Conditions (hereinafter “GTC”) form an integral part of the concluded tenancy agreements and their provisions are binding. They govern the relationship between the tenant and AAS Apartment Service AG (hereinafter “AAS”, “we”, “us”, or “our”). Deviations from these GTC shall only apply if explicitly agreed between the tenantand AAS and confirmed in writing.
These GTC are also available in an English translation. In the event of any contradiction or discrepancy between the German and the English version, the German version shall prevail exclusively.
2. Conclusion of Contract
2.1 Rental Property and Use
a. The apartment is provided furnished and with the features described in the listing. The apartments shown on our website reflect the style of the apartment. Deviations from the images are possible. The apartments may be viewed prior to booking.
b. Tenants may use the apartment exclusively for residential purposes. The tenant may only sublet the property, in whole or in part, with the landlord’s written consent. Commercial use is not permitted.
c. The house rules must be observed.
2.2 Confirmation of Tenancy
The confirmation of tenancy for an apartment becomes binding as soon as we receive it in writing, either through a signed tenancy agreement or an email confirmation.
3. Prices and Payments
3.1 Payment Terms
The rent must be paid in advance. The deposit is paid together with the first month’s rent.
3.2 Payment Methods
We accept all common means of payment.
4. Late Rent Payment
In the event of late rent payment, a reminder fee of CHF 100 will be charged.
5. Key Handover – Move-in
a. The key handover takes place only after payment of the first month’s rent due and the deposit, in accordance with the tenancy agreement.
b. Occupancy of the rental property takes place as agreed.
6. Duty to Report
The tenant must report any defects in the apartment or the inventory without delay (at the latest within 3 days) after thestart of the tenancy. The tenant is liable for any damage not reported.
7. Residents’ Registration Office
The tenant must register with the competent registration office within 14 days.
8. Final Cleaning
A final cleaning is carried out after move-out, payable together with the first month’s rent. If this exceeds the usualscope and/or excessive waste or personal belongings are disposed of, we must invoice the additional costsseparately. Any damage identified during the final cleaning will be recorded and offset against the deposit.
9. Access to the Apartment
AAS Apartment Service AG always endeavours to inform the tenant in good time before an upcoming access – for example for repairs, maintenance work, or technical inspections. In urgent cases, in particular where there is imminent danger (e.g. water damage, fire hazard, or other emergencies requiring immediate action), employees of AAS Apartment Service AGmay enter the apartment – while respecting the tenant’s privacy – even without prior notice. For apartments under notice, viewing appointments with potential subsequent tenants may also be arranged by prior notice.
10. No-Smoking Policy
All of our apartments are non-smoking apartments. Smoking in the apartment is not permitted. Any damage causedby smoking and any necessary measures will be charged to the tenant.
11. Termination
a. Termination by the Tenant: The tenant may terminate the tenancy at any time in writing (letter or email), subject to a notice period of 30 days. The tenancy ends 30 days after receipt of the termination notice by the landlord, regardless of the calendar day or end of month
(termination effective to the day).
b. Termination by AAS: AAS may terminate the tenancy in writing, using the official form, subject to a notice period of 3 months, effective at the end of any month.
c. The tenant must vacate the apartment no later than the last day of the applicable notice period and return the keys as agreed.
d. Termination for breach of the duty of care (Art. 257f CO) remains reserved, in particular in the event of improperuse of the apartment (Clause 23), violation of the pet policy (Clause 20), or violation of the no-smoking policy (Clause 10).
e. Default in Payment (Art. 257d CO): If the tenant is in default with rent payment, the tenancy may, after anunused grace period, be terminated with 30 days’ notice to the end of any month, and eviction may be soughtthrough the courts. The tenant remains liable for the rent until expiry of the ordinary notice period under lit. a, tothe extent the apartment cannot be re-let.
f. If the tenant vacates the apartment without observing the notice period under lit. a (e.g. immediate move-outwithout termination), rent remains owed until expiry of a notional 30-day notice period calculated from theactual move-out date or from the date AAS becomes aware of it.
g. Cancellation before commencement of tenancy: If termination occurs before the tenancy has commenced, the cancellation conditions under Clause 12 shall apply. 12.
12. Cancellation Before Commencement of Tenancy
a. Cancellation up to 30 days before the start of the tenancy is free of charge.
b. Cancellation between less than 30 and 15 days before the start of the tenancy results in an administrative fee of 10% of the monthly rent.
c. In the event of cancellation less than 15 days before the start of the tenancy, the entire contractual rent for the first month is owed. However, if the customer provides an adequate replacement tenant, an administrative fee of10% of the monthly rent will apply.
13. Contract Amendments
If, at the tenant’s request, subsequent contract amendments are made that require the reissuance of the tenancy agreement, an administrative fee of CHF 150 will be charged.
14. Move-out – Return of Keys
a. The tenant must contact the office one week before the move-out date to arrange the return of the keys.
b. Should the keys not be returned and the tenant fail to vacate the apartment on time, AAS is entitled to clear theapartment. For the security of the next tenant, the tenant will be charged CHF 800 for replacing the lock cylinder.
15. Loss of Keys
If a key is lost, the lock cylinder will be replaced for security reasons. For this, the tenant will be charged an amount of CHF 800.
16. Refund of the Deposit
The deposit will be refunded within 4 weeks after termination of the tenancy and upon receipt of the deposit refundform. All outstanding items and any damage caused by the tenant will be offset against the deposit.
17. Rental of Parking Spaces
The rental of parking spaces is not part of this agreement. Any claims and conditions will be governed by a separate rental agreement between the parties.
18. Internet Use
Each apartment has WiFi. The tenant is not permitted to make any changes of any kind to the installations orconfiguration. In case of non-compliance, the tenant will be made liable for the
costs of any necessary reinstallation or troubleshooting. For damage caused by spam, viruses, or spyware resultingfrom use of the AAS network, no liability can be accepted. We strive to maintain a consistently functioning internetconnection but cannot guarantee it and disclaim any liability in this regard.
19. Use of the Fitness Equipment
Each tenant is personally responsible for the use of the fitness equipment. We ask you to use it correctly and, inparticular, to report any damage to the equipment immediately. We disclaim any liability for the use of the fitness equipment.
20. Pets
a. Keeping pets is only permitted with the prior consent of AAS. The tenant is fully liable for all damage caused by the pet.
b. A violation of this provision constitutes grounds for termination of the contract under Art. 257f CO by AAS Apartment Service AG. In this case, the tenant owes the rent until expiry of the ordinary notice period underClause 11 lit. a. If the tenant provides a reasonable replacement tenant, only an administrative fee of 10% of one month’s rent will be charged.
21. Emergency
The tenant has access to an emergency telephone number. For self-inflicted emergencies, such as loss of keys, andemergencies that could have been resolved during normal office hours, we will
charge an hourly rate of CHF 150 plus a travel flat fee. The emergency locksmith service will be charged separately (cost depending on time spent).
22. Liability
a. The tenant undertakes to treat the apartment, inventory, and building with care. Damage not attributable tonormal wear and tear, as well as missing inventory, will be invoiced to the tenant and offset against the deposit (see Clause 16). If failure to observe this duty of care requires renovation of the apartment, the tenant is liablefor the resulting loss of rental income.
b. AAS Apartment Service accepts no liability for the loss of or damage to valuables kept in the apartment.
c. The tenant is responsible for taking out their own theft and liability insurance. We disclaim any liability.
23. Use of the Apartment
The apartments are to be used exclusively for residential purposes. Commercial use is not permitted. In the eventof unlawful or contractually non-compliant use of the apartment, we reserve the right to terminate the tenancy withimmediate effect. The tenant is liable for any outstanding rent.
24. House Rules
The general house rules as posted in the stairwell of the respective building must be observed. Bicycles may not bestored in the apartment, on the balcony, or in the stairwell.
25. Applicable Law and Jurisdiction
This contract is governed by Swiss law. The parties recognize the ordinary courts at the location of the property as the place of jurisdiction for disputes arising from this contract.
26. Data Protection
In connection with a stay with AAS Apartment Service AG, personal data of all guests is collected. We processpersonal data in accordance with the Federal Act on Data Protection (Data Protection Act, FADP), the Data Protection Ordinance (DPO) and, where applicable, the EU General Data Protection Regulation (GDPR).
